
A Federal judge has rejected the argument of a chemical manufacturer in reference to a lawsuit brought by a Summerville resident.
The chemical manufacturer, Daikin America Inc. was asking questions concerning whether or not a chemical manufacturer is responsible for damages caused by the negligent disposal of its product.
U.S. District Court Judge Thomas Thrash stated that while the concept of supplier negligence in this case is a new one, the applicable law regarding that topic is not.
“It is well within this court’s competence to apply old law to new facts; indeed, it would be untenable to certify questions to a state supreme court every time an unfamiliar fact pattern emerges,” Thrash wrote in the order.
The ruling by Judge Thrash will be important in the case brought by Summerville resident, and former Summerville City Councilman Earl Parris.
