The Georgia State Patrol released a report about a DUI arrest that happened in Chattooga County on November 24th.  According to the report, a state trooper clocked a vehicle doing 75 mph in a 55 mph zone on Highway 27.  The trooper performed a traffic stop and spoke with the driver who said he didn’t have his driver’s license on his person.  The driver told the trooper he was on his way to his mom’s house to get his license.  The trooper noticed a strong smell of marijuana and asked the driver if he had been smoking.  The driver said that he had about two hours prior and that he “didn’t smoke much”.

I believed the driver may be impaired so I asked him to perform field sobriety test and the driver advised why am I doing
that. I advised the driver because he may be impaired. The driver advised no, and then asked if he could go get his phone so
he could talk to his momma. I advised the driver he could not get his phone. The driver asked why, and advised he would
like his momma to be in this conversation. I advised the driver all I’m asking you to do is field sobriety. The driver advised I
don’t get that. I advised the driver because you may be impaired and the driver advised I’m not. The driver then asked what
do you think I’m impaired on and I advised him marijuana drugs. The driver then shook his head as if he was saying no. The
driver asked so what will happen if I decline it? I advised the driver he would go to jail. The driver advised I can’t talk to my
momma? I advised the driver no and advised him he was 20 years old. The driver advised me he was shaking and that I had
him all nervous. Then the driver stated “Yeah lets go ahead and get it done and over with.” Then the driver looked up and
stated “I know I’m gonna fail it and you’re gonna take me to jail either way.” I asked the driver why are you going to fail it?
The driver advised because I’m shaking. The driver advised he’s gonna be in jail tonight. The driver advised he’s gonna fail
the test. I asked why are you going to fail the test if you’re not impaired. The driver advised because I’m not impaired. The
driver advised because I’m shaking and everything. I asked the driver again if he wanted to do field sobriety. The driver
advised no sir and turned around and put his hands behind his back. I put hand cuffs on the driver and advised him he was
under arrest for DUI. I asked the driver how old he was and he advised 20. I read Georgia Implied Consent from the green
card for suspects under the age of 21 and requested his blood. The driver gave me a verbal no and he stated “I’m not giving
no blood tonight.” 

Twenty-year-old Nicholas Wayne Jacobs was arrested and booked into the Chattooga County Jail on charges of Driving Under the Influence.
