A step-daughter, unwanted guests, and a gun, combined to make a dangerous brew Monday night.

That deadly combination has led to the arrest of a 52 year old Walker County man on a charge of murder.

According to incident reports – three men had come to "party" with Michael James Gobert's step-daughter who lives in a mobile home on his property behind his house; Walker County Sheriff Steve Wilson said at some point an argument broke out in the mobile home with the altercation eventually spilling out into the yard.

That noise caused Gobert to wake up, and he went outside armed with a .40 caliber Glock.

After he fired a "warning shot", the three young men got into their car to leave; however he then continued to shoot, firing off between 10 and 15 rounds – striking one man in the head causing his death.  He has been identified as 31 year old Johnny "JJ" Montgomery II.  30 year old Edruis Jamel Putman was hit once in the leg, leaving only 28 year old Deisman Harrison

to escape without injury.

That incident took place around 11:00pm on Straight Gut Road.

Sheriff Wilson says, under Georgia law this was not a justifiable use of deadly force because Gobert was not in immediate threat of bodily harm.
