A hearing is scheduled for this morning related to the racketeering case involving Chattooga County resident and former maintenance director for the Floyd County Board of Education, Derry Richardson.

According to Floyd Superior Court documents, the hearing was requested by acting Special Assistant District Attorney Michael Lambross to hear a motion for a preliminary injunction and to continue receivership in the case.

The hearing was originally scheduled for August 27, but was continued.

The state began seizing property belonging to Richardson on April 14 under Georgia’s RICO Statute.

The complaint alleges that Richardson and others engaged in and committed at least two or more acts of racketeering activity in violating state law relating to theft against the school system.

No criminal charges have been filed yet.

Today’s hearing is scheduled for 9 a.m. in the courtroom of Judge Walter Matthews
