Summerville Police issued a trespass warning following a complaint at a residence on Montgomery Street, according to a police report.
Officers responded to the call after making contact with the complainant, Patsy Sanchez, who told police that her brother, Justin Durham, had arrived at her property despite no longer living there. Sanchez advised officers that Durham had been removed from the residence several months earlier and was supposed to be living with his father as part of probation conditions. She reported that Durham arrived at the Montgomery Street residence during the early morning hours.
Sanchez also told officers that Terry Davis, who resides at the home and has already been served with an eviction notice, may have allowed Durham inside to get out of the cold. Officers explained that Davis was still legally allowed to have guests until his eviction date and advised Sanchez on appropriate legal options should the issue continue.
Police then went to the residence and made contact with Terry Davis, who stated that he had not invited Durham inside and that Durham entered the home on his own. Officers requested and received consent to conduct a security check of the residence to confirm Durham was no longer inside.
During the check, officers located Justin Durham, instructed him to leave the property, and issued him a criminal trespass warning.
