Commissioner Winters held a hearing this morning at 10:00 concerning the synthetic marijuana busts that occurred early last month. The Mountain Top Store located on Highway 48 and BJs Food Mart located on Highway 27 received disciplinary action from the Malt Beverage Board and had their alcohol license suspended for 14 days.

The owners of the stores sought legal representation through Mr. Bobby Lee Cook, who claims that Commissioner Winters has “absolutely no jurisdiction or authority” to appeal the ruling of the Malt Beverage Board.

Mr. Cook also stated “We… have no personal animosity towards anyone. Our position is strictly a legal one.”

Commissioner Winters is still awaiting authoritative response as to whether or not he has legal jurisdiction to appeal the Board’s ruling.

Sheriff Mark Schrader presented evidence at the hearing stating that deputies from the Sheriff’s office were able to purchase synthetic marijuana as undercover customers several times. Both stores received letters from the Sheriff’s Office stating that they were able to purchase illegal substances. BJs Food Mart denied further attempts to purchase the substances, but the Mountain Top Store continued to sell.

Sheriff Schrader stated that his personal preference for disciplinary action would include both stores losing their business licenses, but after learning Chattooga County does not issue business licenses, he sought response from the Malt Beverage Board. He agrees with the board and is “content with the Board’s decision.”

Officers traveled to the Highway 27 Save-A-Lot on June 6th due to damage of property. The store manager told officers that one of the employees went to buy a beverage from their coke machines and saw that the machines had been broken into. 

All of the money, including coins, had been taken from two of their machines.  Officers also noticed that two other machines at two other locations, Salon Complete and Advance Rehabilitation, had been broken into as well. An investigation is still ongoing. 

A woman living on Valley View Ranch Road called officers to report a theft on June 6th. The homeowner noticed several items missing from her home, including a handgun and other weapons, a Bass Pro Member ring, a necklace, hair styling tools, and a iPhone. The theft is still under investigation as officers search to find the person that took the woman's belongings.

Chattooga County officers were called to a local residence on June 4th after receiving a call about property damage. After contacting the homeowner, she told officers that her husband came to her house while she was visiting her parents. While at the house, the husband allegedly broke an Alabama Crimson Tide stepping stone and placed it on the front porch steps. 

After placing the broken stone on the steps, the husband proceeded to defecate on the stone and the front porch. He also allegedly urinated on a bag of clothes that had been placed on the front porch as well. The husband had been harassing his wife through text and facebook messages.

For the week of May 13 -June 9 2014, Chattooga County  Animal Control reports it investigated 32 cases,  Impounded 38 animals, stray animals/Owner Surrenders turned in were 58, returned 13 animals to their owners, adopted 4 animals, 35 animals went to rescue, euthanized 6 dogs, and 16 cats.

Animals that have been picked up or brought to Chattooga County Animal Control may be available for adoption or rescue after a three day holding period, which allows time for owner reclaims.  Chattooga County Animal Control is located off Hwy. 100  at 464 Red Oak Road.  From Summerville, turn left on Red Oak Road  before you get to Georgia Power.  The Center is located at the end of the road on the right.  The adoption fee for male dogs is $75, female dogs $85, male cats $40, and female cats $50.  This includes spay/neuter and rabies shot at the Summerville Veterinary Clinic.  Those people adopting animals who want to use a different veterinarian  must pay a $25 adoption fee and provide proof of spay/neuter within 30 days.

According to Warden Jeff Chandler and Floyd County Jail records, Daniel Scott Milstead, 33, did not return from the Floyd County Work Release Center on May 21.

He was arrested in Chattooga County and charged with misdemeanor escape. Chandler said Milstead was being held on a misdemeanor probation violation.

The Work Release Center allows its residents to work and earn money will serving their sentence. All residents are screened before entering.

Milstead has been terminated from the program.

One hundred percent of residents that have not returned have been arrested, Chandler said.
