Earlier this month, a Chattooga County deputy and Summerville Police officer responded to a call regarding a potential intoxicated driver at the local McDonald’s drive-thru. Forty-seven-year-old Lavoid McCutchins was found to have an open container of alcohol in the console of the vehicle he was driving in while pickup up food at the drive-thru window.

The deputy and police officer ordered McCutchins to move his vehicle to a more secluded area of the parking lot behind McDonald’s to conduct a thorough DUI investigation.

During the investigation, Mr. McCutchins admitted to consuming alcohol earlier that morning, and a medical questionnaire revealed that he had some ongoing hip problems and was borderline diabetic, though his blood sugar was stable at the time. As officers spoke with the suspect, a strong odor of alcoholic beverages was evident on his breath.

McCutchins was placed under arrest for DUI and open container violations. During the reading of the Implied Consent notice, the suspect became uncooperative, yelling and refusing to agree to the terms. Ultimately, he was transported to the Chattooga County Jail, where he was booked on the DUI and open container charges. Deputy Smith later confirmed that the open container was a glass “shooter” bottle containing alcohol.
