On Tuesday of this week Lookout Mountain Superior Court Judge Brian House ruled that two Walker County School Board members must appear in Walker County Superior Court and prove that they can legally hold their positions.
The board members are Mike Carruth and Karen Harden. Both school board members have a son each that holds administrative positions in Walker County Schools. Under Georgia law, no one can serve on a school board if they have immediate family members serving as system administrative staff in the local school system that they represent.
Walker County resident Chelsea Cagle had filed a petition for a quo warranto hearing that would require Walker County the two school board members in question to provide proof that they legally hold their seats on the school board.
Judge House agreed with the petitioner and has ordered both school board members to appear in court and prove they can legally represent the public on the Walker County School Board.
A date has yet to be set for the hearing.
