The Atlanta Journal Constitution reported over the weekend that a Republican lawmaker that had introduced a bill to drug test welfare recipients failed a sobriety test given by Atlanta Police.

Representative Kip Smith was issued a DUI after an officer convinced him to blow into a hand-held "intoxometer" and he registered a .091 – above the legal limit of .08.  Smith is the sponsor of House Bill 464 which would require drug-testing of all welfare recipients in Georgia.

Democrats responded with a bill introduced by Representative Scott Holcomb that would require all lawmakers in Georgia to be drug tested.
