A lawsuit naming a number of members of law enforcement, the Cherokee County Commission, the Town of Collinsville and the Town of Cedar Bluff – among others – as defendants, has been filed by Michael Jenkins.

Jenkins is the father of Brian Jenkins, who died in an auto accident while attempting to elude law enforcement on the night of April 5th, 2009.

The suit states that Brian Lynn Jenkins was traveling north on County Road 17 in Sand Rock and was being pursued by – Cherokee Count Deputy Tracey Dixon – Collinsville Officer Lee Harrison and Cedar Bluff Police Officer Sgt. J.P. Curry.

The suit goes on to say the defendants negligently, wantonly and with disregard for public safety collided with the vehicle driven by Jenkins and as a result Brian Jenkins suffered severe bodily injuries when the impact caused his vehicle to leave the roadway and flip several times – ejecting him through the windshield on impact, causing death
