The Lyerly Town Council reviewed a draft of the Distilled Spirits Ordinance at their work session held on Tuesday evening.
The town’s attorney has advised several changes to be included in the ordinance and has also advised changes to the application, notably the inclusion that any applicant must reside where distilled spirits can be legally sold at least 12 months prior to applying for the license. No more than two retail licenses will be allowed, including relatives of the owner.
Council member Josh Wyatt proposed using the same stipulation as the Beer and Wine Ordinance, which requires a 300’ distance from property lines of the park. Councilman Robert Thompson agreed with that proposal and asked that the non-refundable fee for background investigation be included under “Transferability” as well as the “Processing Application” section.
The council also discussed whether to allow the sale of liquor on Election Day which is not currently prohibited in the Beer and Wine Ordinance, and whether to prorate license fees.
Mayor Jessica Eller said that there would be an update to the drafted Ordinance with many of these changes and the council will vote on the Distilled Spirits Ordinance at the regular meeting coming up next Tuesday evening.
