The Alabama Court of Civil Appeals has concurred with a ruling issued by DeKalb Circuit Judge Randall Cole two years ago. The case revolved around allegations that run off from chicken litter at properties in the Mentone area was polluting adjoining properties as well as the west fork of the Little River. Judge Cole in August 2007 ordered that Larry Gray Farms, Gray Farm and P.J.’s Poultry Playhouse in Mentone would have to take steps to minimize groundwater runoff onto property owned by the plaintiffs. The defendants will also have to maintain temporary sediment traps already in use, so as to make them effective for trapping silt and turbid water flowing into them. The chicken farms would also have to use the services of a “certified waste hauler” for the removal of waste from their chicken houses in accord with state environmental regulations
