The Georgia State Fire Marshal’s office says that a roller coaster at Lake Winnepesaukah was functioning properly after a woman fell from the ride on Sunday, June 10th.

The state fire marshal’s office oversees inspections of all amusement rides in Georgia and was called in to investigate the accident.  Donna Kirby was injured after falling from the ride, but state officials say that the lap bars on the “Wild Lightning” ride were functioning properly at the time of the accident.

According to a statement from Kirby’s attorney that was released to the media yesterday,  Kirby says she told the ride attendant beforehand that she had knee issues that made it difficult to fully bend them. The statement states that after Kirby locked down the lap-bar against her legs, two attendants looked and said it was safe to continue. After going around a sharp turn, despite holding onto the hand rails with both hands, Kirby’s legs slipped out from the lap-bar and she fell about two stories.

The statement says Kirby suffered a broken clavicle, fractured shoulder and upper arm, requiring surgery.

The state fire marshal’s report states, there was “no indication of malfunction,” and that there were no rule violations at the time of operation.
