A traffic stop last week ended in the arrest of two men charged with drug possession.
Summerville Police said that they stopped a vehicle with a drive-out tag to check proof of ownership. When they walked up to the driver’s window they could smell a strong odor of marijuana coming from the vehicle. Both the driver and the passenger denied smoking marijuana. Police asked to search the vehicle and the driver asked, “What for?”. The officer explained that there was a strong smell of marijuana.
After getting consent to search, officers found marijuana and evidence of a white powdery substance believed to be methamphetamine inside the vehicle. Officers also found a men’s underwear bag that contained a set of digital scales.
Fifty-four-year-old Pierre Howard Price and thirty-one-year-old Cody Landon Boyd were both taken into custody and booked into the Chattooga County Jail on drug charges.

In Pennsylvania, there can be a humongous odor of marijuana, and that is not probable cause to search a vehicle. This new law just passed earlier this year. I don’t know about other states so move here if you like smoking weed while driving. I bet it is the same law in Colorado, Rocky Mountain Hiiiiiiigh !!!

The reason for that I assume is because the officer could say that about any vehicle and there is no way to prove that he didn’t smell it on the body camera footage. I’m dealing with this kind of ridiculousness in MN here, a lawyer told me to just roll down the window a crack for your Id and papers and then the officer won’t be able to claim that they smell some phantom hallucinatory odor. I did just that, the officer kept trying to get me to roll my window down saying What?!?! I can’t hear you!!?! Im all, dude. I can hear you just fine. This must have just made him all the more determined because he ended up dragging me in and forcing me to give blood when they couldn’t find anything. In his report he put ‘his experience and training has taught him that people do that (only open the window a crack) to mask the odor of drugs. Funny how you can skew any set of details the way you want them when you’re given a badge and a gun.
im in Colorado and was pulled over allegedly for no plates. the officers asked for everyones ids and apon return asked everyone to step out of the vehicle. he immediately put me in cuffs and began to search me, later saying in the discovery that i told him to search me and empty my pockets and his reason for searching was the fact that i was sweating and looked nervous. i thought they were just spossed to do a pat down for weapons… i am now going to court for a df2 and getting ahold of the public defender is a joke. i can already tell that they ain’t going to help my situation none. any one have any legal knowledge i cant afford a lawyer.
