Knollwood Circle House Burns After Fireworks

Immediately after the fireworks at the City of Summerville's annual 4th of July Celebration, city firetrucks and ambulances took off with lights and sirens blazing to a Knollwood Circle address in reference to a house fire. The light from the fire could be seen from the recreation department.

Accoriding to a report by the Summerville Fire Department, several fire departments responded to the extensive blaze at 310 Knollwood Circle, that burned the majority of the home.  

Those responding were the Summerville, Hays CI, Lyerly and Trion Fire Departments as well as Redmond EMS.   No one was injured in the blaze. 

Sheriff Comments on Appeals Court Ruling

Chattooga County Sheriff John Everett Friday morning discussed with AM 1180 a ruling in a case involving the Sheriff's Department that was issued Wednesday by the U.S. Court of Appeals. AM 1180 reported on the order Thursday in which the court deemed an appeal filed by Deputy Kandy Dodd "frivilous." 

The appeal was in relation to a  a search warrant that was used to search the home and business of a local businessman, Mark Gordon and his wife, several months ago.  

Earlier AM 1180 reported that a ruling was made on the appeal by Dodd and Everett.  Sheriff Everett took exception with that saying that he was not mentioned in that ruling. Everett was correct, he was not named in the ruling which only names Dodd. However, he is listed as a defendant on the front page of the order he provided AM 1180.  Technically, Everett is not a defendant in this particular ruling and his case is entirely separate.

Officially, the ruling only affects Dodd since Everett's case was separated from Dodd's earlier.. 

The Gordon's had filed a civil suit against Dodd and Sheriff Everett for the "illegal and unconstitutional invasion of their home.  U.S. District Court Judge Harold Murphy made a ruling calling the search "illegal and unconstitutional" and that Deputy Dodd was liable for damages to be assessed by a Jury in Federal Court.  Following that ruling, Dodd  appealed Judge Murphy's ruling to the U.S. Court of Appeals.

On Wednesday U.S. Court of Appeals made a ruling that the appeal of Dodd  was frivolous and had no basis in law and further ordered that Deputy Dodd would be required to pay all costs and attorney's fees for the filing of the frivolous appeal.  This award will be in addition to any damages that a Jury will assess for the unconstitutional violation concerning the illegal search.

There is something different about this opinion according to unnamed legal experts. It includes only the ruling and no opinion. 

Corrections Head to Speak at Chamber Luncheon

The Chattooga Chamber of Commerce will have its July luncheon July 11 at noon at the Summerville Depot.

Georgia Department Corrections Commissioner Brian Owens will be the guest speaker.  

The Chamber's newest member is Farmer's Furnitute. A ribbon cutting is set for  9 a.m. July 12 at the store, 10991 Commerce Street, Summerville. 

 

Tractor Parade July 4th

The American Heritage 4th of July Dry Creek Tractor Parade is set for Wednesday, July 4, at Dry Creek.  The second annual parade is set for 9 a,m. to 11 a.m.

Anyone with a tractor is invited to bring it to the parade and it will be decorated.

the parade will begin at the Northeast section of Dry Creek Rd., at it's intersection with East Armuchee Road and travel down Dry Creek Road to Haywood Valley Road at Ebenezer Church.

Spectators are invited to find a spot along the route to pull off the road and watch.

Last year about 15 tractors participated in the spur of the moment parade. This year at least 25 tractors are expected. For more information call Leon Smith at 706-857-5239. 

 

Heat Wave Continues

The heat wave continues over northwest Georgia and the Southeast.

 

Afternoon temperatures will be dangerously high today and especially Saturday and Sunday when humidity levels are expected to rise. Heat indices today are expected to reach 100-105 degrees. For tomorrow and Sunday they are expected to reach 105-110 with an increase in humidity.

 

You should limit your outdoor activities and take steps to protect yourself and your pets.

 

Know the signs and symptoms of heat exhaustion and heat stroke.

Heat exhaustion symptoms are heavy sweating, weakness, cold, pale and clammy skin, a thready pulse, and possible fainting and vomiting.

Heat stroke is a severe medical emergency that occurs when the body temperature reaches 106° F. or higher. Symptoms include hot dry skin, rapid and strong pulse, and possible unconsciousness. Summon immediate emergency medical assistance.

 

Wear light colored, loose fitting clothing

 

Drink plenty of water

 

If you are planning an outing tomorrow, the time to begin hydrating yourself is today.

 

Check frequently on the elderly and disabled.

 

Emergency Management is monitoring this dangerous situation and could, if necessary, open a cooling shelter for the elderly.

Summerville Council Rejects All Water Project Bids

In a called meeting Thursday night, the Summerville City Council rejected all of the bids it received for it's upcoming Lyerly/Mohawk Water Project.  The problem — the lowest bid was about $198,000 over the city's current budget. In all 5  bids were received ranging from $931,000  to  $1,183,000.  According to City Manager Russell Thompson the city will now revise the scope of the project making it more affordable.  Thompson said the new bids should come in around August 2nd.

 

Trion Hires Gordon Lee Coach

The Trion Board of Education in a called meeting Thursday night unanimously approved the hiring of the defensive coordinator of one of it's biggest rivals. Josh Groce is a graduate of Gordon Lee, played football for Gordon Lee and most recently was the defensive coordinator for the Trojans. This fall, Groce will be defensive coordinator and teach high school PE for Trion.

The board also approved a new fundraiser for the school — The First Annual Trion Texas Hold "Em Tournament. Proceeds from the tournament which is slated for mid December 2012 will go to purchase travel shirts for the football team and linemen/skill gloves.

In other business, the board approved Kelly Wilson as Director of Federal Programs and Larry Sentell as Elementary Art teacher, as well as the retirement of Darlene Rowe, elementary art teacher. Rowe has been employed at Trion Schools for 30 years and is responsible for the hand print tiles and murals that grace the walls of the elementary school. 

 

Report Released on Downtown Crash

The City of Summerville Police Department has released its report on a crash that occurred in Downtown Summerville on Tuesday afternoon.

According to the report, Linda Johnson of an Orchard Hill address told officers she was sitting at the intersection of Commerce Street  at East First Avenue in her 2004 Chrysler Pacifica  waiting for the light to turn green so she could cross onto West First Avenue. She reportedly said the light turned green, she attempted to cross over Commerce Street and was hit by 2001 Chevrolet Equinox.

The driver of the Equinox, who is a juvenile, told police that she was traveling North in the right lane of Commerce Street  and started through the intersection of First Avenue with a green light.  She said she saw the Chrysler pull out into Commerce and tried to avoid a collision by moving to the left  lane but was prevented from doing so because there were vehicles in the lane beside her. She told police she had nowhere to go and the vehicles collided.  That collission caused the Equinox to overturn onto its top with the juvenile and another passenger inside.  

A witness to the accident told police that she was stopped in her vehicle in the left hand northbound land of Commerce Street while the light was red. She said the Equinox came by her in the right lane while the light was still red an entered the intersection while the Chrysler was pulling  into the intersection.

All of the women involved in the accident were wearing lap and shoulder restraints according to the report. Though all were transported to the hospital and  all have since been released. 

Governor’s Drug Task Force Flies Helicopters Over Chattooga

If you've noticed helicopters flying in various area of Chattooga County today, it's the Governor's Drug Task Force and the Chattooga County Drug Task Force looking for marijuana growing in the county.

According to Chattooga County Sherriff John Everett the hunt for pot plants has been on since about 9 a.m.

Just after 2 p.m. today, about 10 members of the local and state drug task force were waiting on the ground for word that marijuana had been found. However, so far nothing had been found.

The flyover began with two helicopters but was reduced to one by mid afternoon. Everett said the helicopter search will continue until about 4 this afternoon. We will have more information as it becomes available.
